TERMS AND CONDITIONS / SERVICE AGREEMENT
PLEASE READ THIS TERMS AND CONDITIONS AGREEMENT PRUDENTLY. IT IS A LAWFULLY BINDING AGREEMENT GOVERNING THE CONTRACT BETWEEN YOU, THE CUSTOMER, AND THE JUNK NINJAS.
By securing and placing your rental order, large item pick up, and/or cleanout service, you recognize that you have read this Agreement, comprehend it, and approve to be bound by it. If you don’t approve to any of the terms below, THE JUNK NINJAS is unwilling to provide goods or services. If you are unwilling to accept all the terms of this Agreement, you should not secure or place an order. If you’ve already secured an order before studying this Agreement, and if you do not agree to the terms of this Agreement, you must withdraw or cancel your order before any equipment is delivered to the work site.
EXPLANATION OF SERVICES
THE JUNK NINJAS will deliver the temporary use of waste disposal equipment (often times referred to as dumpsters, containers, or bins) and junk removal services as approved amongst the parties at the time the Customer places an order online, in-person, email, text or via phone. THE JUNK NINJAS tries to perform all services in a safe and professional method, consistent with state licensing requirements, guidelines governing such procedures, and the terms of this Agreement. THE JUNK NINJAS uses vehicles and equipment that are operated by skilled operators, insured, and sustained in good working order.
CUSTOMER RESPONSIBILITIES
The Customer agrees to accept the following commitments:
Equipment Damages
THE JUNK NINJAS understand that trash and junk can be dirty and the normal disposal of waste is expected. Any significant dents, damage to doors or hinges, exterior paint scratches, and items that tear/dent the dumpster are examples of damages. Customer shall bear the risk of loss and damage to equipment including but not limited to damage or loss caused by theft, vandalism, forces of nature, use, or misuse of the equipment. In the event of damage, Customer shall pay the lesser of (a) the cost of repair, or (b) the cost of replacement, which will be billed to the Customer in the event of loss. No loss or damage to equipment, in whole or in part, shall impair Customer’s payment obligations under this Agreement. Customer shall be responsible for personal injury and/or property damage arising from or relating to Customer’s negligence or unauthorized movement or misuse of the equipment.
Dumpster Security
The customer is solely responsible for all individuals or equipment used in conjunction with in and around the dumpster. The customer assumes all risk associated with all users of the dumpster. Additionally, the customer shall be responsible for any personal injury and/or property damage arising from use, miusue or relating to the customer’s negligence, unauthorized movement, or misuse of the equipment.
Prohibited Items
These items are prohibited tires, paint, dirt, concrete, rocks, lacquers, oils, asbestos, infectious waste, contaminated soils and absorbents, inks and resins, fuel, hazardous/ toxic or flammable materials, and no appliances with freon. Customer acknowledges and agrees that the item(s) only consist solely of non-hazardous general solid waste and/or construction and demolition debris or other inert waste and recyclable materials. We will charge the credit card on file 4 times the amount of the fee we get charged for any and all prohibited/hazardous materials in the dumpster as well as a $250 container cleaning fee.
Weight Limit and Overages
Each dumpster has a specific weight limit according to the size of the dumpster.
12 Foot – max weight is 2,000 lbs
15 Foot – max weight is 3,000 lbs
20 Foot – max weight is 4,000 lbs
If the customer exceeds that weight limit, the customer will be charged $.08 per lb over the limit. Safety is a priority for us, if the dumpster has exceeded it’s weight limit the driver may refuse to pick up the dumpster until some of the weight has been unloaded. If an additional dumpster is needed to remove material from the overloaded dumpster, another dumpster can be ordered online. Please note: the initial rental continues until the dumpster is loaded to a safe weight. In case this issue causes your rental to exceed the included days, you will be billed for each additional day at the rate of $50.
The Customer acknowledges that the truck and trailer are obsessive weight, Customer agrees to not make THE JUNK NINJAS liable for any damage that may be made to Customer’s concrete, stone, asphalt, or any other type of driveway or sidewalk.
Dumpster Overloaded
Customers shall never overload above the side rail of the dumpster. The driver may refuse to pick up the dumpster and a trip charge ($150 – $250) fee. The customer will need to remove items to get the items to the fill line.
If an additional dumpster is needed to remove material from the overloaded dumpster, another dumpster can be ordered online. Please note: the initial rental continues until the dumpster is loaded to a safe weight. In case this issue causes your rental to exceed the days included, you will be billed for each additional day at the rate of $50.
Lack of Accessibility
At the time THE JUNK NINJAS arrives to make a delivery or pick up for removal dumpster or large items pick up, and it is blocked, gate locked, or prevented from delivering or picking up dumpster or large items pick up the customer will be charged a Accessibility Fee ($50 – $250 based on time, item(s), distance, and fuel).
Bulk Item Pick Up
At The Junk Ninjas, we take great care to safely and efficiently move and remove large items from within homes, apartments, and other units. Our team will make reasonable efforts to avoid causing any damage during the handling, moving, or removal of bulk items.
However, by scheduling a bulk item pickup or removal service, the customer acknowledges and agrees that The Junk Ninjas shall not be held liable for any incidental damage that may occur to drywall, flooring, carpeting, door frames, furniture, or other fixtures as a result of moving or removing large items.
The customer further agrees to hold harmless and indemnify The Junk Ninjas from any claims, damages, or losses arising from or related to such activities.
We encourage customers to take appropriate precautions, such as clearing pathways and securing delicate items, prior to service to minimize the risk of accidental damage. We recommend that all bulk items be placed outside of the unit and ready for pickup. Additional charges may apply if entry into the unit is required to retrieve items.
Mattress Disposal
Additional charges may apply for the disposal of mattresses and box springs. Please note that many landfills have started implementing separate fees for the handling and disposal of these items. Any applicable mattress disposal fees will be added to the customer’s final invoice.
Cancellation and Rescheduling
Cancellation or rescheduling must be made 12 hours before the earliest time slot the customer selected for the dumpster rental scheduled delivery date or 12 hours before the earliest time slot the customer selected for the large item pick up scheduled pick up date. All cancellations made after that time frame may be subject to a trip charge ($150 – $250).
Payments and Fees
The customer will pay THE JUNK NINJAS in accordance with THE JUNK NINJAS’ recognized pricing for the services provided and any fees that were quoted to the Customer at the time the order is placed and secured. Any supplementary fees may be charged to the Customer due to over-filling or overweight dumpsters (overweight according to purchased tonnage), placing restricted Items or Prohibited items in a dumpster, or otherwise violating any Customer duty under this Agreement. If THE JUNK NINJAS is incapable of making a delivery and/or removal due to safety issues and/or lack of accessibility; Customer will be charged a $150 – $250 trip charge (service attempt) fee. Payment for “services attempt” will be charged to the credit card provided by Customer. This provided credit card may also be charged for any and all supplementary charges that may have sustained counting but not limited to: overweight charges, daily rental charges, trip charges, etc. Extra charges may appear on an ensuing credit card statement from the original charge. By submitting the credit card or other payment agreement or by providing the Customer’s credit card info over the telephone or online, the Customer permits THE JUNK NINJAS to charge the fees to the account provided by the Customer.
The customer remains responsible for all payments and applicable fees, regardless of whether payment is made by credit card or pay in-person.
All rental payments, large item pickup charges, cleanout service fees, and any associated service costs must be paid prior to or at the time of service.
Any additional charges, including but not limited to overweight fees, equipment damage fees, trip charges, or other post-service fees, are due within 24 hours of notification.
Permits
Customer acknowledges that certain locations and/or uses of the Equipment may require a permit, license, certification or other local, municipal, city, county and/or state approval relating to the possession, placement, storage and/or transportation of the Equipment (collectively referred to hereinafter as a “Permit”). Customer acknowledges and warrants to THE JUNK NINJAS that Customer (and not The Junk Ninjas) is solely and exclusively responsible for obtaining and maintaining all necessary and required Permits relating to Customer’s possession and use of the Equipment. In the event that Customer fails to obtain and/or maintain all necessary and required Permits, THE JUNK NINJAS may arrange for the pick up the Equipment without prior notice to Customer and without any liability to Customer.

Indemnification
The Customer explicitly agrees to defend, indemnify and hold harmless The Junk Ninjas from and against any and all damages, expenses, penalties, fines, and charges resulting from or arising out of the failure to eliminate Prohibited Items or any other failure of the Purchaser to conform with its commitments under this Agreement and applicable law.
Customer agrees to indemnify, defend and hold harmless company and its officers, directors, members, employees, agents, parent companies, affiliates, subsidiaries, successors, subcontractors, vendors, and assigns and the service provider from and against any and all claims, counterclaims, suits, demands, actions, causes of action, damages, setoffs, liens, attachments, judgments, debts, fines, penalties, charges, expenses, costs or other liabilities of whatsoever kind or nature (collectively, “losses”) asserted or alleged by any third party arising from or related to: (a) overage expenses; (b) customer’s failure to obtain and/or maintain any required permit; (c) customer’s use, storage, or deposit of prohibited materials in the equipment; (d) loss or theft of the equipment; (e) damage and/or destruction of the equipment during the applicable service term; (f) personal injury and/or property damage relating to customer’s use and/or possession of the equipment; (g) physical damage to streets, roadways, driveways, walkways, pavement, curbs, wells, irrigation systems, landscaping, lawn, septic systems and/or underground utilities caused by the equipment including, without limitation, any damage to customer’s property from leaks or stains relating to the use of the equipment; (h) customer’s breach of this service agreement; and (i) any fees, penalties, fines, assessments, charges, costs and expenses asserted by a third party (including, without limitation, a towing company) or anyone who moves the dumpster incurred in connection with the movement, placement and/or use of the equipment.
Attorney Fees
The customer agrees not to seek reimbursement for attorney fees or court costs from The Junk Ninjas. In the event that The Junk Ninjas must initiate legal action to recover unpaid balances, fees, or other monies owed, the customer agrees to pay all attorney fees, court costs, and any additional expenses incurred by The Junk Ninjas in enforcing its rights under this agreement.
LIMITATIONS AND WARRANTIES OF WARRANTIES
THE JUNK NINJAS warrants that it will commence commercially rational energies to deliver the equipment and services demanded by the Customer in a timely means. THE JUNK NINJAS is not accountable for interruptions or losses due to reasons outside its realistic control, including, without control, acts of nature, strikes or work stoppage, unattainability of equipment, laws, or withdrawn access. EXCLUDING AS CLEARLY STATED IN THIS AGREEMENT, THE JUNK NINJAS DENIES ALL EXPRESS OR INDIRECT WARRANTIES, PLUS, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OR SUITABILITY FOR A SPECIFIC PURPOSE.
LIMITATIONS OF LEGAL RESPONSIBILITY
THE JUNK NINJAS shall not be answerable for damages to pavement, fencing, utilities, landscaping, property, lawns, or other like exterior items. EXCEPT AS SPECIFICALLY PROVIDED IN THIS SECTION, NEITHER THE JUNK NINJAS NOR ITS AFFILIATES SHALL BE ACCOUNTABLE FOR ANY UNINTENDED, INCIDENTAL, DISCIPLINARY, SUBSTANTIAL OR SPECIAL DAMAGES, OR FOR LOSS OF PROFITS, WHETHER OR NOT DAMAGES WERE CONCEIVABLE AND EVEN IF THE JUNK NINJAS WAS COUNSELED THAT SUCH DAMAGES STOOD PROBABLE OR LIKELY. IN NO OCCASION WILL THE AGGREGATE OBLIGATION OF THE JUNK NINJAS TO THE CUSTOMER FOR ANY AND ALL CLAIMS ASCENDING IN CONNECTION WITH EQUIPMENT OR SERVICES PROVIDED BY THE JUNK NINJAS EXCEED THE TOTAL FEES PAID TO THE JUNK NINJAS BY THE CUSTOMER DURING THE SIX-MONTH PERIOD PREVIOUS THE DATE OF ANY CLAIM. THE CUSTOMER CONCEDES THAT THIS LIMITATION OF LIABILITY IS AN VITAL TERM AMONGST THE CUSTOMER AND THE JUNK NINJAS WOULDN’T DELIVER THE EQUIPMENT OR SERVICE LACKING THIS LIMITATION.
Changes to Terms
The Junk Ninjas reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our services after any changes constitutes your acceptance of the new terms.
